Easements and Neighbors

New Civil Code  841:    Effective 1/1/14, adjoining owners must equally share the responsibility for maintaining and repairing boundaries and monuments between the properties.  The statute creates a presumption that the division fence equally benefits the neighbors and that the costs for maintenance, repairs and construction are to be equally shared.  The presumption can be overcome by a written agreement between the neighbors.
